The Amani National Congress (ANC) leader, Musalia Mudavadi, has denied any role in a contract entered between the government of Kenya and two foreign companies in the year by 2002 for the procurement of internet services.

Mudavadi testified that he never played any role apart from signing letters awarding the contracts.

He further testified that his tenure ended, therefore, he could not tell whether the equipment procured were delivered or not. The then Minister of Transport told the court that the contract agreement was signed by the former Permanent Secretary Sammy Kyungu and counter signed by Samuel Bundotich, the financial officer.

He said that he never interacted with Spacenet and Mercantile companies but admitted signing letters seeking support from the Ministry of Finance after he was informed that the Postal Corporation required the new technology to improve services. During cross examination, Mudavadi said that the decision to have a direct procurement was not personal.

The Amani coalition leader further exonerated the four accused persons of any wrong doing saying that the procedure in procuring the said services was legally done.

“Everything, the procedure including the paperwork was duly followed,” Mudavadi said.

He was testifying against Kisii Senator Chris Obure in the Anglo Leasing scandal. Obure has been charged alongside former Information PS Sammy Kyungu, former Postmaster-General Francis Chahonyo and Samuel Bundotich.

They are charged with abuse of office over a contract signed between the Kenyan government and two US companies to supply internet services in 2003.

Other people lined up as prosecution witnesses include Busia Senator, Amos Wako, who was the Attorney General and former Central Bank Deputy Governor Jacinta Mwatela.
