ICC used witnesses from Kriegler, Waki reports  Kuria

Gatundu South MP Moses Kuria has claimed that the International Criminal Court may have used witnesses from the Kriegler and Waki reports.

Kuria said the witnesses were specific for the report and not ICC, adding that the office of the prosecutor at the ICC should have carried out its own investigations.

On his part, Stephen Tarus, former Emgwen MP reiterated Kuria’s pronouncement saying the witnesses in the two reports were only meant to establish that PNU won the 2017 elections and not act as witnesses on ICC cases against individuals suspected of fanning the post elections violence.

Tarus stated that the office of the prosecutor at the ICC should have done its own investigations to prosecute individuals in connection with the violence instead of relying on the Kriegler report.

Kuria further thanked the ICC for contacting him and scheduling a meeting on October 9th 2015 over the on-going cases.

He said the speaker of the National Assembly, Justin Muturi, has allocated the Parliament Buildings Committee room as the venue for the meeting.

Kuria has been at the centre of a heated debate with CORD luminary Raila Odinga and Narc-Kenya party leader Martha Karua after he linked the two to the on-going cases against William Ruto.

“We all know the violence experienced in 2007 came about because of political differences between PNU and ODM over the contested elections,” said Moses Kuria.

“Both ODM, led by their party leader Raila Odinga and Kisumu Senator Anyang Nyong’o, and PNU, led by myself and Martha Karua, sent letters to the ICC with names of individuals suspected to be behind the violence.”

He accused Raila and Kisumu Senator Anyang Nyong’o of writing a letter to the UN Security Council opposing the deferral of the cases and advising that the suspects be tried at the ICC in The Hague.

Karua has proceeded to sue the Gatundu South MP for defamation over the remarks which linked her to fixing Ruto at the ICC.

Raila has ordered Kuria to apologise for the utterances of face legal action, an order Kuria has ignored saying he is ready to face the CORD leader in court.

The Narc Kenya leader claims that Kuria’s statement has tarnished her name causing her embarrassment in public eye and tainted her image as a leader.

Karua has also sought a court order barring Kuria from making further utterances on the matter pending hearing of the case.

She further called on the Jubilee Alliance and its affiliate parties to stop mentioning her in the on-going prayer rallies.
