IEBC moves to terminate case challenging tender award

The Independent Electoral and Boundaries Commission (IEBC) has asked the court to dismiss a case filed by the opposition challenging the award of a tender to audit firm KPMG for the review of voters register.

The commission claims that the audit of the register of voters was subjected to views by stakeholders and at no point during the consultative meetings with the opposition and other political parties did the commission receive any objection, reservations or opinions with regards to the alleged lack of commissioners to make the impugned decisions.

In its response, the commission says that it complied with the Elections Laws Amendment Act No. 36 of 2016 to the extent applicable to the audit of the register of voters.

“The commission did not breach or go against the ec-parte Applicant legitimate expectations, “states IEBC.

The electoral body says CORD has not demonstrated that it has suffered or there is likelihood that it will suffer any injury in future  as a consequence of the impugned decision, it cannot purport to seek  courts protection on unfolded allegations.

In the main case Coalition for Reforms and Democracy (Cord) moved to court challenging the decision to award KPMG the tender.

The audit is meant to authenticate genuine voters in the register by weeding out ghost voters who may include names of the dead, the underage and double registration.
