Judge in Pattni case to appeal removal from office
A day after the Tribunal investigating him recommended his removal from office, suspended High Court Judge, Joseph Mbalu Mutava, now says that his next move is to appeal the decision at the Supreme Court.
The judge, though his lawyer, says that the decision by the Tribunal was ridiculous, adding that all complaints against him were withdrawn.
“We uphold the rule of law, the Constitution, but justice must be done. You cannot sacrifice one individual because of crimes committed by other people,” said Philip Nyachoti, Mutava’s lawyer.
Nyachoti says that they have a strong case and will fight to the end adding that they have several grounds of appeal.
On Wednesday, September 21, the Justice David Maraga-led Tribunal unanimously recommended the removal of the judge after finding that three of six allegations against him were proven.
Mutava was accused of demanding 2.5 million shillings to get a favorable judgment in a land case in Karen.
He was also accused of terminating the 5.8 billion shillings Goldenberg scandal case against businessman Kamlesh Pattni.
