Judge Odunga to decide whether he will hear KPMG tender case

 

Nairobi High Court Judge George Odunga will today (Thursday) make a ruling on whether he will continue hearing the case filed by the Coalition for Reforms and Democracy (CORD) regarding the voter register audit tender awarded to KPMG.

The Independent Elections and Boundaries Commission (IEBC) wants Justice Odunga to recuse himself from hearing the case as they are apprehensive that the recent outcome of the ballot papers printing tender case decision, in which they lost, could affect the outcome of the case at hand.

Through advocate Wambua Kilonzo, IEBC also put an alternative application that the judge sends the matter before the chief justice to constitute a judge bench to hear the case for a varied outcome.

IEBC insisted that should the judge hear and determine the matter, they are likely to be sent back to the drawing board yet they are working within strict election time lines.

CORD have opposed the application stating that it will only be fair if the IEBC counsel puts in a sworn affidavit with his application since the case was meant to proceed for hearing, saying it is an ambush to make an oral application before court.
