Kitany wants court order barring Linturi from evicting her extended

A lawyer representing Maryanne Kitany in the case against Meru Senator Mithika Linturi has urged the court to extend interim orders that granted her access to their home in Runda.

According to the advocate, the Senator can call his client (Kitany) a visitor, slay queen but she has a right not be evicted forcefully.

“This court has jurisdiction to provide the orders granted and has a duty to protect any person whether a slay queen ..a prostitute any word that is used in a stay dump relationship,” he said.

The lawyer further noted that the matter before the court deals with the protection against domestic violence and not a divorce case to find out whether there was a marriage which would be dealt with by the court in Meru.

He added that the replying affidavit does not deny that the applicant has been staying at the Runda house neither does it deny that she was staying there according to him (Linturi) as a visitor and that she was ejected.

Linturi’s lawyer had said Keitany must satisfy the court on the existence of a relationship between his client and Kitany.

On Monday, he had revealed that papers presented in court indicating that Linturi had divorced his wife Mercy Kaimenyi were forgeries.

“Linturi has never filed a divorce case against his wife,” the lawyer told the court citing a marriage certificate dated April 2005 from Tigania Catholic Parish in Meru.

A ruling is to be delivered on February 1.
