Keter, Birdi Petition to Block their Arrest to Be Heard Tuesday

The Director of Public Prosecution has stated that the petition should also enjoin the Inspector General of Police and the Director of Criminal Investigation in the petition before the case kicks off.

Justice Mumbi Ngugi has, however, stated that there will be no prejudice if the two are not enjoined in the case.

This comes just a few days after an attempt by Nandi Hills Member of Parliament Alfred Keter and his nominated counterpart Sonia Birdi to block their arrest and prosecution over corruption allegations flopped.

FUNDAMENTAL FREEDOMS

In their petition through lawyer Okong'o Omogeni, Keter and Birdi have argued that EACC intends to curtail their fundamental freedoms by criminally charging them for offenses falling under leadership and integrity provisions.

The lawmakers termed the cases political and were meant to embarrass them.

They further argued that since all EACC commissioners have quit, the body has no mandate to charge them.

The two MPs have already received summons to appear in court on Wednesday to answer to charges of creating disturbance, incitement to disobedience of the law and intimidation.
