Kidero impeachment motion fails for lack of quorum

A motion to impeach Nairobi Governor, Dr Evans Kidero, failed to take off Tuesday, October 11 afternoon for lack of quorum to discuss it.

The motion had been brought to the county assembly despite a court order stopping the Members of the County Assembly from discussing it.

Nairobi County Assembly, which has 127 MCAs, needed at least a third (43 MCAs) for the house business to proceed, and two thirds (87 MCAs) for Kidero to be ousted from office, but only 24 MCAs, allied to the Jubilee coalition, were in the Assembly Chambers for the debate.

However, Viwandani MCA, Samwel Nyang’wara, who tabled the motion claimed that nobody could stop the motion and that the governor was personally responsible as he is the accounting officer of the county.

“Nobody can stop an idea whose time has come,” said Nyang’wara, stating that Governor Kidero was ‘buying’ members to ensure there was no quorum for the house business to run.

Minority Leader and Kahawa West MCA, Patrick Chege Ngaruiya, allied to the Jubilee coalition, said they had decided to proceed with the impeachment motion despite a court order barring the same.

“A court order cannot stop a constitutional process,” further added the MCA who also questioned why only Jubilee governors had been impeached in other counties.

Ngaruiya claimed that Governor Kidero was running away from accountability and that he had influenced some of the county assembly members by paying them not to attend the sittings.

However, George Kithi, Kidero’s lawyer, in a quick rejoinder claimed that they had not been served with any document detailing the claims against Dr Kidero saying that “you cannot charge an individual for general allegations.”

He stood his ground that the court order barring the motion must be obeyed, and the law must be respected.

The motion followed claims that Kidero violated the constitution, misappropriated funds and had apparently refused to be held accountable.

The session was adjourned for lack of quorum and the motion pushed to Wednesday, October 12 at 2:20 pm.
