Kisii Governor James Ongwae to know his fate today

The Court of Appeal, will today give its judgement on the appeal challenging the election of Kisii Governor James Ongwae.

The appeal was heard by a three-judge bench: Justices Milton Makhandia, Kathurima M’Inoti and Gatembu Kairu.

Two voters; Makori Onsando and Francis Mochoge, filed the appeal after their dissatisfaction with Justice Helen Omondi’s judgement in February that upheld the election of Ongwae.

According to Justice Omondi, the petitioners did not prove any of the allegations in their petition.

The two are challenging Governor Ongwae’s election over claims that the Governor’s election was not conducted in a free, fair and transparent manner.

The petitioners, through their lawyer Edward Begi, urged the court to set aside the High Court judgement that upheld the election of Governor Ongwae.

They also appealed seeking that the court finds that the August 8 elections were not conducted according to the law.

Senior council Okong’o Omogeni, representing Governor Ongwae, however urged the court to uphold the High Court judgement and dismiss the appeal.

IEBC, through Murugu and Rigoro Advocates also told the court that the election was conducted in a free and transparent manner and in accordance to the law.
