KRA boss Njiraini fights petition to send him home

KRA boss John Njiraini now says that case seeking to have the board send him on compulsory leave is meant to demean his status and should be dismissed.

Njiraini says that he has not sought for an extension of his contract as the Commissioner General of Kenya Revenue Authority beyond the stipulated expiry date, contrary to claims by activist Okiya Omtatah.

Omtatah accused the chief taxman of failing to send Njiraini on terminal leave pending his retirement further claiming that the commissioner is quietly scheming to have his tenure extended.

Njiraini has however dismissed the claims as “baseless” saying his appointment to the office is well founded in law and that his term will come to an end in March 2018.

He says the case by Omtatah is speculative as he has not applied for any extension and neither has the KRA board made any public pronouncement of its intention to renew his terms.

“This court should not countenance false allegations made without any basis to embarrass and demean me,” said Njiraini who was appointed on March 4, March 2015 for a term of three (3) years.

“According to the contract that I signed with the KRA board of directors , it is expressly provided that my engagement with the KRA is for a period of three (3) years commencing March 4 , 2015 and that period is set to expire March 3 , 2018” says Njiraini

In the case, activist Okiya Omtatah moved to court seeking to have the KRA board to immediately retire Njiraini and simultaneously commence the process for recruiting and appointing a new Commissioner General for the Kenya Revenue Authority in strict compliance with the law.

Omtatah argues that from the time Njiraini turned 58 years of age, the board together with National Treasury Henry Rotich were under obligation of the law to commence the process of identifying his possible successors to enable Njiraini’s smooth exit from the service when he attains the mandatory retirement age of sixty (60) years.

He claims that the impugned intended extension of the tenure is discriminatory against all those public officials who have exited the public service upon turning 60 years of age.
