Labour Court reverses earlier order on NMS, declares it legal

The Labour Court has lifted earlier orders that had declared the creation of the Nairobi Metropolitan Services illegal.

Justice Hellen Wasilwa said that applicants-NMS- have demonstrated the involvement of the Nairobi County Assembly in the transfer of functions to the National Government.

“It is therefore my finding that the applicants have demonstrated to this court by exhibiting evidence of the involvement of the County assembly in the transfer of functions to the National Government. I, therefore, find that the declaration of illegality of the Nairobi Metropolitan services as created is now lifted,” the court papers read.

In June, Justice Waswa declared as irregular and vague, the Deed of Transfer of Functions executed between the National Government and Nairobi City County Government.

During the ruling, she said the deal which was brokered by State House had not been approved by the County Assembly.
