Lady sacked for humiliating CS Matiangi sues employer

A former Kenya Airports Authority (KAA) officer has sued her employer for allegedly mistreating Education Cabinet Secretary, Dr. Fred Matiang’I, by making him queue during a security check.

In papers filed in court in Nyeri, the complainant, Daisy Cherogony, says she was unfairly dismissed and efforts to settle her grievances outside of court have not yielded fruit.

In a petition filed in the Employment and Labour Relations Court in Nyeri, the complainant maintains that her termination from the Kenya Airports Authority is unfair detailing the events that led to her dismissal from work.

Prior to her dismissal, she appeared before a disciplinary committee on April 19 to answer to charges of “mistreating and humiliating the Education Cabinet Secretary Fred Matiang’i by requiring him to line up which almost led him to miss his flight.”

She was suspended from duty and later fired.

According to the petition, the accuser says on the 5th of April 2017, the Education Cabinet Secretary was at the airport accompanied by a police officer and others who were “shouting and trying to force their way without going through the passage queues.”

She says the security manual states that “Cabinet Secretaries usually queue like normal passengers unless they have special passes.”

Dr Matiang’i, according to Daisy, did not have the requisite documents that would allow him in the airport without screening.

The petition says that she was accused of a wrong that does not exist stating that she had diligently done her job as a security supervisor.

Daisy says she was wrongfully terminated from work, was never afforded a fair hearing and was never shown any complaint written by the Education Cabinet Secretary.

She argues that she was not given any warning and was victimized and discriminated by her employer.

Now she wants the court to declare her termination unfair and be awarded Ksh 2.4 million for wrongful dismissal.
