Lawyer Assa Nyakundi opposes murder charges in sons death case

Embattled lawyer Assa Nyakundi on Thursday strongly opposed murder charges preferred against him by the prosecution.

This came after State Counsel Catherine Mwaniki asked the court to have Nyakundi taken to Mathare hospital for mental check- up before answering to murder charges.

Appearing before Justice James Wakiaga, the defense lawyers said the application by Mwaniki was full of malice and venom and should therefore be dismissed.

Nyakundi’s lawyers argued that the prosecution still has an ongoing case before Kiambu Law Courts which has never been withdrawn. They thereby argued that the prosecution has no right to bring up another case before the High Court.

Mwaniki, in response, said the Director of Public Prosecutions (DPP) has the power to institute any charge against any accused person even with another matter pending in court.

Nyakundi was, however, released on the strength of the manslaughter bail he had paid but is expected to appear in court on Friday.

The city lawyer, who is facing murder charges against his 29-year-old son Joseph Bogonko Nyakundi, was arrested on Wednesday moments after leaving his lawyer John Khaminwa’s office in Kileleshwa.

Kiambu High Court Judge Christine Meoli disqualified herself from hearing the case citing conflict on interest since the accused was a classmate.
