Lawyer who wants Sonko out of office fined Ksh.5K

A city lawyer who wants Nairobi Governor Mike Sonko removed from office has been ordered to pay Ksh.5,000 after the case was adjourned yet again.

The case was to be heard on Wednesday but the petitioner Boniface Nyamu asked for an adjournment through his lawyer.

The court was told that the petitioner is unwell.

High Court Judge James Makau said the application for adjournment is unjustifiable but however adjourned the case to August, noting it to be a very serious matter.

In his petition, Boniface Nyamu, an advocate of the High Court, has cited several grounds for Sonko’s removal among them the recent ban on matatus from the city centre.

He has also accused the governor of verbally assaulting a member of the Nairobi County Assembly, recording private phone calls and refusing to nominate a deputy governor.

“When we were electing the Governor, we elected him alongside his deputy governor in consideration that they would complement each other in terms of politics and development but immediately the respondent was sworn in, he started frustrating his deputy until the Deputy governor resigned,” argues the lawyer.

The lawyer alleges that ever since Sonko was elected, he has “reneged on all his promises and is totally clueless on what is happening in the city.”

He wants the court to bar the governor from transacting any county business until the case is heard and determined.

Mr Nyamu has also cited other grounds for removal such as his consistent habit of posting ‘insulting’ messages on his social media platforms and claims he made on Citizen TV’s popular JKL show that he smoked bhang.

Sonko told the show’s host Jeff Koinange that he had smoked cannabis sativa (bhang) within the precincts of the National Assembly with the current Kiambu County Governor.

Mr. Nyamu presented evidence in support of this including unprintable insults hurled at Environment CS Keriako Tobiko at a public function.

A leaked phone recording between Sonko and Governor Waititu was also cited where the governor said he was willing to break the law in favour of his counterpart.

This is termed by the petitioner as gross violation of the constitution, since as a public officer, Sonko is obligated to uphold the law.

“That the respondent should not break the law, confess about it, chest thump of his legal actions and still expect to rule millions of law abiding citizens of the city,” Nyamu says, adding that the governor’s actions appear to be the newest low in leadership.

The respondent has also been accused of negligence for failing to replace Mr. Polycap Igathe one year after he resigned as deputy governor.

Sonko has however denied allegations that the county government has degenerated in its stature saying there is no statistical bases, benchmarks or any finding of expertise on which the allegations can be termed as conclusive.
