Lawyers accuse State of mischief in arrests of Justices Muchelule & Chitembwe

The Kenya Judges and Magistrate Association has filed a court petition seeking an injunction to prevent the DPP and DCI from prosecuting or arraigning Justice Aggey Muchelule and Said Chitembwe.

The association also wants the court to prohibit the IG, DCI, and DPO from investigating, recommending, or initiating any prosecution that intends to disgrace the two judges, according to its lawyer Danstan Omari.

The woes that beset the judges, according to lawyer Danstan Omari, reek of malice.

“The due process was not followed, if there are issues, you first inform the JSC not proceed to arrest them,” Omari said on Friday “What were the charges? Who was the complainant, these people were arrested and released without bond”

The two Judges who are part of the six who were not appointed by President Uhuru, according to the Lawyer, are targets of the law-bending State.

“The game of the DCI was to get the Judges out of the chambers and then plant money there before conducting the search,” Omari added. “Why did they conduct a search without the Judges lawyers present”

The two judges were arrested on Thursday and a search conducted in their offices.

They were later released after writing statement.

The magistrate and Judges Association argue that the respondents’ judgment and behaviour amount to an abuse of office, according to court documents filed on Friday morning at the Milimani law court.
