LSK plans to move to court over new security measures for public gatherings

The Law Society of Kenya will move to court on Monday to challenge the National Security Advisory Council over the newly announced measures on public gatherings.

LSK President Nelson Havi said the advisory is ill-bent and has no place in the Constitution.

“Everyone has a right to assemble,” he said adding that the State has habitual disregard of the law.

He was speaking on Saturday during an event in Kibra, Nairobi to mark Huduma Day.

Cabinet on Thursday approved the NSAC measures on requirements for public gatherings, media reporting and social media conduct.

NSAC Chairman Joseph Kinyua announced that the council resolved that leaders intending to hold a public gathering must notify the Officer Commanding Station (OCS) of such intent 3-14 days before gathering.

They will also be required to be present at such a meeting and help police in maintaining order, ensuring that they obey orders given by the OCS.

On Saturday, Havi also spoke about CJ David Maraga’s advisory to the President in regards to the dissolution of Parliament.

According to him, Kenyans should come to terms with the fact that they will have no MPs after the advisory expires.

CJ Maraga, in his unprecedented move, said that Parliament has refused to comply with the High Court order to enact legislation required to implement the two-thirds gender rule for over nine years.

“It is incontestable that Parliament has not complied with the High Court order in Constitutional Petition No. 371 of 2016. As such, for over 9 years now, Parliament has not enacted the legislation required to implement the two-thirds gender rule which, as the Court of Appeal observed in its said judgement, is clear testimony of Parliament’s lackadaisical attitude and conduct this matter,” says the President.
