Magistrate accused of bribery fails to take plea

A Kericho magistrate who was arrested by Ethics and Anti-Corruption Commission (EACC) officers for allegedly receiving a bribe on Friday failed to appear in a Nakuru court to take plea.

Through her lawyer, Magistrate Judith Nyagol sought deferral of the plea on grounds that she was ill hence could not avail herself in court to answer to the charges.

Her court clerk Robert Cheruiyot who is facing similar charges, was in court but could not take plea following the judge’s plea extension application.

Principal Magistrate Wakumile Ndururu ruled the prosecution failed to effectively challenge the magistrate’s medical report and ordered Nyagol take plea on September 3rd.

Attempts by the magistrate to stop the EACC and Director of Public Prosecution offices from initiating criminal proceedings against her on Wednesday was rejected by the court.

The Kericho magistrate and her court clerk are said to have received 10,000 shillings as a bribe from a second generation brew dealer whose case was before the court.
