Magistrate in Babu Owinos attempted murder case recuses self over bail controversy
Milimani Chief Magistrate Francis Andayi has disqualified himself from hearing Embakasi East MP Babu Owino’s attempted murder case.
Andayi said that the prosecution – DPP has written a complaint to the Judicial service Commission on the bail that he granted the legislator.
Further, the court directed that the matter be heard by magistrate Bernard Ochoi.
The case will be mentioned on March 2.
Babu is facing two criminal charges – an unlawful attempt to cause the death of a Nairobi DJ Evolve and carrying a firearm while drunk and disorderly.
Babu was released on a cash bail of KSh.10M and was directed to pay in instalments.
The magistrate further directed that the money would be used in settling the hospital bill of the DJ.
It is this direction that the DPP wrote a letter to the JSC and also filed a review of the said order.
At the same time the MP filed an application for review if his bail saying that he is broke.
