Man accused of killing nurse to undergo mental exam

A Nairobi court on Monday ordered that a man accused of killing a nurse undergo mental assessment.

Joseph Njoroge Mungai, who was arraigned in court on murder charges is accused of having shot dead a nurse at Chiromo Lane Medical Center on December 6.

He was denied bail when he appeared in court on Monday as the State argued that a mental assessment of accused persons conferred upon murder charges had not been conducted, as per the law.

“The accused cannot be granted bail at this juncture, to remain detained for 14 days,” said the judge Jessy Lessit

State counsel, Catherine Mwaniki argued; “We are not saying that he is mentally ill, but that is the procedure that he be examined before taking the plea. We request that the accused be remanded pending examination.”

Mungai’s lawyer, Cliff Ombeta, had urged the court to release his client on bail stating that the report did not need to be done while the suspect was in remand.

“The accused was taken to the Chief Magistrate’s court and released on a cash bail of KSh.2 million. He was then brought to court on murder charges. This is a person who can be granted bail. Let the report be done while he is out,” he said.

The court, however, denied the application and ordered for the accused to be remanded and be taken for mental assessment.

The case will be heard on December 27.
