Man accused of sexual assault says victim has not checked up on him

A man charged with sexual assault of a minor on Wednesday shocked the court when he said the victim has not checked up on him.

Cyrus Kusimba Masinde lamented that it has been one week since he was arrested but he has not seen the 16-year-old girl.

“I do not know where she is. She is not in court and has not checked up on me since my arrest,” Kusimba said.

The magistrate dismissed his sentiments saying he did not see why the accused person would want the victim to visit him.

Masinde was charged on two counts; sexual assault and committing an indecent act with a child contrary to section 11 of the Sexual Offences Act.

“On the diverse date of the month of January and February 2019 at Kibagare slum in westlands sub-county, intentionally touched the breast and vagina of E.S a child aged 16yrs old with his hands,” the charge sheet reads.

Appearing before Magistrate Kennedy Cheruyot, the accused pleaded not guilty to all the charges and was released on a Ksh. 1million bond.

The case will be heard on August 10, 2019.
