Man in court to stop Senator Omar from competing with Joho

A Mombasa-based voter has moved to the court seeking to have Senator Hassan Omar barred from contesting for the gubernatorial seat claiming he is still is still a state officer and failed to resign as required by the law.
 
In his petition, Hamiliton Mwakitele Walongo, argues that the Independent Electoral and Boundaries Commission (IEBC) erred in clearing Omar to run for the seat without vetting him to establish whether he had complied with all constitutional requirements.
The petitioner now wants a declaration that all elected leaders who are seeking gubernatorial positions in the August 8 polls, apart from sitting governors and MCAs are ineligible to be elected for the seat.
 
In a petition filed under a certificate of urgency at the Mombasa High Court through lawyer Jesse Oduor, the petitioner claims that the Senator is in contravention of Article 193(2)a of the Constitution.
