Man in Narok jailed for 20yrs for defilement, impregnating minor
A Narok Court has jailed a man for 20 years after it found him guilty of defiling and impregnating a 13 year old girl.
Wilson Letuya Nkoiboni, 22, committed the offence between December 2013 and August 2014 contrary to section 8(1) of the sexual offences act No. 3 of 2006.
The court was told that the man defiled the girl at Olenkomei area Narok North; the victim testified in private.
On November 2, 2015, the prosecution applied for and was granted DNA results of the child, the victim as well as the accused.
However, the results from Kipngetich Bernard at the Government Chemist Department based in Nairobi exonerated the accused as the biological father of the child.
On mitigation, the accused pleaded with the court to have leniency on the sentence saying he was a businessman and that he had allegedly slept once with the minor but regretted his actions.
While reading the judgment on Thursday, Narok Chief Magistrate Wilbroda Juma said the accused had committed a serious offence and deserved to serve the whole sentence in prison.
He was given two weeks to appeal the matter but will remain in custody.
FEMALE GENITAL MUTILATION
In the same court, two women; Faith Chebet Koech and Faith Chepkorir were found guilty of procuring female genital mutilation (FGM) contrary section 20 (a) as read with the Mutilation Act number 32 of 2011.
That the accused on November 22, 2017 in Kutete village in Mulot Narok West procured the services of Elena Tereget to perform FGM.
Following a tip-off to the area administration officers and police, she was arrested alongside others not in court.
Upon mitigation, Chepkorir said she regretted her action pleading for leniency since she was taking care of her late brother’s children.
She added that she depends on selling water as business but Juma regretted that FGM is common in the area thereby ordered her to pay Ksh.200,000 or serve 3 years in jail.
The court also found Koech guilty of a similar charge through a satisfactory medical report and was also fined Ksh.200,000 or 3 years imprisonment.
Upon mitigation, Koech said she regretted the offence vowing never to repeat again but the court judgment stood.
The two women have 14 days each to appeal against the judgment.
STOLE MAASI RUNGUS
In the same court four Morans namely Alex Oldavas, Moses Tirori, Jackson Keshien and Joshua Loweiyie appeared for the first time accused of allegedly robbing Nicholas Kibet Korir aged on 27th February 2019 at Oldonyonarasha area in Olenkuo Village Narok South.
The court heard also that the four who were armed with dangerous and offensive weapons among them spears, Maasai rungus allegedly robbed Korir of a Techno mobile phone worth Ksh.1,500 and 22 herds of cattle valued at Ksh.700,000 and immediately before such robbery had struck the said Korir.
The four who were appearing before Magistrate Juma for the first time were also charged in a second count of handling suspected stolen property with another one not in court contrary to section 322 (1)(2) of the penal code dishonestly undertook the removal and retention of 22 herds of cattle knowingly belonging to Nicholas Kibet Korir.
The four pleaded not guilty and Juma ordered for second accused Moses Tirori who is alleged to have been beaten by a mob be taken to Narok referral hospital for treatment.
Their case will be heard on 15 April this year while mention has been slated for 14th March this year as the court directed a probation within two weeks to investigate homes of the accused to ascertain whether they qualify for a bond.
Meanwhile the three will remain in custody as the death penalty awaits them if found guilty of theft with violence.

Accusation over cattle theft involving the Maasai and Kipsigis communities bordering each other in parts of Narok North and South has always led to deadly clashes leading to loss of life and property in recent times.
