Man sentenced to 25 years in jail for defiling minor

A Nakuru court has sentenced a middle-aged man to 25 years in jail after he was found guilty of defiling an 11-year-old girl.

Appearing before Nakuru Senior Resident Magistrate Judicaster Nthuku, Robert Sialo Simiyu was accused of committing the offence on February 12, 2011 and escaping arrest from his Pangani home in Nakuru County, seeking refuge in Busia County.

“Following the evidence the prosecution has proved beyond reasonable doubt that the accused committed the heinous act on the minor and as per the sexual offence act 8(2) covering minors aged below 11 years and two months, I sentence the accused to 25 years imprisonment,” ruled Nthuku.

Earlier, the court was told the minor had left her underwear in the accused’s room after she was forced out of the room when her mother unexpectedly showed up looking for her.

The mother told the court that the accused had been her daughter’s tutor, giving her remedial classes after school before committing the crime.

The court heard that Simiyu, who has been on the run, had caused a delay in the case.

He was arrested in January 2016 in Busia.

Meanwhile, police at Lwanda Police Station in Kakelo-Kakoth sub location in Nyatike, Migori County are holding a 33-year-old man accused of defiling a 7-year-old girl on Tuesday.

The accused, Calvince Ochieng, who hails Homa Bay County has reportedly been living with his brother-in-law at Nyora Village over the past four months forcefully defiled the minor as she went about her chores.

Speaking to Citizen Digital, Kakelo-Kakoth sub-location assistant chief Mr Sospeter Oloo said the minor had gone to fetch firewood in a nearby forest when the accused defiled her.

Mr Oloo said they managed to arrest the suspect as he was trying to flee the area.
