Man sues condom company after condom broke, ruined marriage

A man has filed a suit against Beta Healthcare, Kenya Revenue Authority (KRA) and Kenya Bureau of Standards (KEBS) accusing them of failing to protect Kenyan consumers by branding consignment of Zoom condoms with the quality mark of assurance.

The petitioner narrated how he used his favorite brand of condoms; Zoom scented chocolate flavored studded condoms, believing he would please his woman and protect him fully but unfortunately it broke during intercourse.

In his affidavit, the petitioner claims it was as a result of the incident that he got infected with a Sexually Transmitted Infection (STI) which he says was later passed to his wife something he says would not have happened had the product been of good quality.

Further, the petitioner claimed that the said product dubbed “The impugned batch” was originally meant to be sold in Uganda but failed all the qualitative tests leading to the National Drug Authority (NDA) declaring it unfit for intended use.

The petitioner now says that following the incident, he suffered a mental breakdown, lost his family and became an alcoholic subsequently losing his job as a result.
