Man Vows to Appeal Ruling in Kenyatta Family Land Case

Peter Mungai Ngengi, who lives 40 kilometres from Kenyatta's home at Ichaweri village in Gatundu, said he is disappointed with the ruling and is already planning to appeal the ruling.

Ngengi's lawyer, Kinuthia Wandaka, said he had already filed a notice of appeal in court, adding that he will be filing the appeal on Monday.

Ngengi, who according to the suit papers is Jomo Kenyatta's step-brother, said the court was unfair in dismissing his suit against former First Lady Mama Ngina Kenyatta over ownership of the land.

In the suit, Mama Ngina Kenyatta is named as the first respondent, President Uhuru Kenyatta is the second respondent while Attorney General is the third respondent.

Uhuru's name was, however, struck out of the case when he became President due to a clause in the Constitution which gives a sitting President immunity from legal proceedings.

Ngengi however said that he is ready to let go of the case if the Kenyatta family compensates him.

COURT RULING

Justice Joseph Onguto struck out the case filed by Mr Ngengi saying the petitioner did not submit any evidence to prove ownership of the land.

Mr Ngengi had moved to court in 2012 alleging that he was wrongly deprived of his three and a half acre piece of land in Ichaweri Gatundu by the late Jomo Kenyatta, in collusion with the ministry of Lands.

The petitioner alleged that his land was wrongly given to the first president by the Ministry of Lands without any compensation being made to him.

He further alleged that the third petitioner proceeded to transfer the said land to Jomo Kenyatta without any regard to the subsisting rights of the petitioner.
