‘Matiang’i is incompetent,’ says man who wants CS impeached

A Kenyan has petitioned Parliament to impeach Interior Cabinet Secretary Fred Matiang’i over alleged violation of the Constitution.

In his petition, Mohammed Mohamud Sheikh said, among other reasons, Matiang’i has grossly violated the Constitution, has been found guilty and fined for contempt of court and is incompetent to hold office.

This comes after the High Court in Nairobi fined Matiang’i, Inspector General Joseph Boinnet and Immigration PS Gordon Kihalangwa Ksh.200,000 each for contempt of court.

The CS however refuted claims from Miguna’s lawyers that he had been served with the said court orders.

Appearing before the Parliamentary Committee on National Security, the CS said his office as well as that of the Inspector General and the Immigration Department had been condemned on the basis of lies fed to the court.

“On demands that I exit or be interdicted because the court found us in contempt of court, that is an active matter in court. We have appealed and I don’t want to be accused of being in contempt of the same court,” he told the committee.

“The 13 or so orders given by the courts on the Miguna issue are ex-parte. We cannot be condemned unheard. We have appealed those decisions at the Court of Appeal this morning.”

A public servant can be removed if any citizen petitions the courts to order their removal, Parliament petitioned to prompt their dismissal, the appointing authority kicks them out or the officials could opt to resign.
