MCA charged with destruction of property

A Nakuru Member of County Assembly (MCA) has been arraigned and charged in court with malicious damage of property belonging to the National Housing Corporation (NHC) .

Francis Njoroge was arrested on August 26th after he and others not before the court allegedly destroyed a perimeter wall belonging to the corporation valued at Ksh 10 million .

The prosecution led by Chief Inspector Cosmus Ikunywa applied for the accused to be remanded at the Nakuru Central police station pending completion of investigations.

Ikunywa argued that after the accused was released on police cash bail he ganged up with others not before court while armed with bows and arrows  and proceeded to the station where he threatened Nakuru OCPD Bernard Kioko.

The prosecution asked the court to have the MCA remain in custody as since the police intended to add more charges against him .

However, Njoroge’s lawyer Hari Gakinya termed the application as politically motivated saying the prosecution had not submitted any legal basis upon which they would hold the accused.

Gakinya argued that there was no compelling reason to deny Njoroge bond adding that being a holder of a constitutional office, the accused was not at flight risk thus he would present himself at the police station at any time when required.

Principal Magistrate Wakumile Ndururu granted the accused a cash bail of Ksh 200,000 or bond of Ksh 2 million with similar surety.

The case will be heard on October 5th, 2015.
