Midiwo ordered to pay Ksh.3 million as court dismisses his petition

Former Gem Member of Parliament Jakoyo Midiwo has been ordered to pay Ksh.3 million after the Siaya High Court dismissed a petition he had filed challenging the election of Elisha Odhiambo.

Justice Esther Maina ruled that Midiwo did not provide sufficient evidence to prove claims that the August 8, 2017 election in Gem was marred by electoral irregularities.

The court ruled that the petitioner neither proved his allegations of bias in the election nor did he provide evidence showing that the Returning Officer interfered with the voting process as he alleged.

The judge added that the petitioner’s claims of voter bribery, violence and undue influence of voters was nothing but hearsay as there was no tangible proof for the same.

The court dismissed the petition and ordered Midiwo to pay Mr. Odhiambo Ksh.1.5 million and a similar amount to IEBC as costs for the petition.

Speaking after the ruling, Midiwo accepted the verdict saying in a court of law there will always be winning and loser.

Mr. Odhiambo welcomed the verdict and urged Midiwo to join him in serving the people of Gem Constituency.
