Migori court orders police to produce suspect ‘dead or alive’

Migori High Court has ordered the Officer Commanding Station (OCS) Kehancha Police Station to produce – dead or alive – a suspect who mysteriously disappeared from the station.

The suspect, identified as Daniel Nyamohanga, was arrested on January 12, 2018, and accused of robbery with violence.

Delivering his ruling, Justice Antony Murima ordered that the suspect be availed in court either dead or alive on or before the end of June 4, 2018.

Justice Murima further said that the testimony given by Kehancha Police Station OCS claiming that the suspect was released from prison on January 16, 2018, after the robbery with violence charges levelled against him could not be proved was not factual.

The Judge also noted that a lot of information in the Occurrence Book (OB) had been altered.

According to him, the testimonies given by the OCS, police officers who were on duty when the suspect was brought to the police station and the Independent Policing Oversight Authority (IPOA) were also conflicting.

The case had been filed by the family of Daniel Nyamohanga, with his wife being the second petitioner, seeking to compel the police to produce the man who went missing from the prison cells only a few days after he was arrested.
