Minors get Ksh 1.4M after betting firms illegally use their photos

Two minors have been awarded Ksh 1.4 million by the High Court after the court found that their photos were illegally used on a billboard by two betting companies without their consent.

“A declaration is hereby issued that fundamental rights and freedoms of the two minors N.T.A and T.O.O were violated by the Green Sports Africa Ltd. actions of using their photograph in the Billboard which was erected next to Unga Housed, Woodvale, Westlands in Nairobi County shared among the two minors,” ruled the court.

The minors, through their parents sued the two betting companies; Green sports Africa Limited and Mcheza Limited, saying that it is illegal to use the images of minors to promote gambling.

The parents further argued that that no payment was made for the said advertisement.

The respondents on their part defended their action saying that the petitioners did not demonstrate how their rights were violated adding that the images of the minors were not used for commercial gain and that the use of the images were not for commercial gain.

“I find no difficulty concluding that the acts complained of violated the minor’s constitutional rights,” the court ruled.
