Moi Kabarak School moves to court seeking a remark of 2016 KCSE

Moi High School Kabarak has filed a Certificate of Urgency at Nakuru Employment and Labour Relations Court (ELRC) asking the court to compel KNEC to remark some papers for the 2016 KCSE exam.

In a letter signed by the Principal, Elishebah Cheruiyot, to KNEC CEO on January 24, the school’s board of management wants remarking of Biology (311 students), Chemistry (293 students), Kiswahili (321 students) and English (324 students) examinations for papers 1, 2 and 3.

Through lawyer Tom Ojienda, the school says the respondent (KNEC) has failed to respond to the applicant’s call to remark the examinations as stipulated in KNEC Act 2012.

“The period within which the respondent can successfully apply ask for remarking as stipulated under clause 13 of the KNEC Charter 2005 is about to elapse and will render the request untenable,” says part of the court document.

The exam body usually has 90 days to remark an examination if an issue raised has sufficient grounds to warrant remarking.

The lawyer adds that the students whose results require remarking will be barred from participating in revision of courses for universities and colleges.

“Failure by the respondent to remark the examination shall adversely affect the course selection of the candidates undertaken by KUCCPS (Kenya University and Colleges Central Placement service) who will lose admission for the courses they have qualified for,” adds the certificate of urgency.

Lady Justice, Roselyne Korir, granted leave for the respondent to file a response in 21 days for the request of remarking of the exam within the stipulated time.
