Mois daughter in court battle with KRA

The daughter of former President Daniel Arap Moi has moved to court challenging a decision by the Kenya Revenue Authority to charge her land tax arrears amounting to Ksh.5 million.

Jennifer Kositanny wants the court to protect her property rights by quashing KRA’s decision to direct the Chief Registrar of Lands to register a notification of charge of her property dated June 15, 1998.

She argues that KRA issued a directive to the chief registrar of lands to encumber property without issuing any notice to her thereby denying her the opportunity to raise an objection to the decision to register a charge over the property.

“Without any opportunity to respond, KRA and chief registrar of land decisions were therefore unilateral, biased and unfair,” the petition reads.

According to Kosittany, the taxman failed to serve her with a notice or opportunity to respond to any tax assessment showing she has tax arrears.

Kositanny  accuses KRA’s of acting in an “unprocedural, biased, illegal, unfair and a clear violation of the principles of natural justice which must guide all administrative actions.”

She claims that she has has been the registered proprietor of the said Naiorbi property since 1981 together with her husband and later the land was transferred to her after the demise of her spouse in 1994.
