Moses Kuria out on Sh1m bail

Gatundu South MP Moses Kuria was on Monday released on bail and bond terms after being in police custody since Wednesday.

Chief magistrate Daniel Ogembo released Kuria on a Sh1million cash bail with an alternative bond of Sh5 million with surety of similar amount.

Mr Ogembo warned Kuria that this was his last chance, adding that if he repeated such utterances in public it would lead to automatic cancellation of the terms.

The magistrate further asserted that Kuria must respond faster to any court summons regarding the case.

The incitement to violence case will be mentioned on 14th December 2015.

He is among several other politicians accused of hate speech and incitement to violence who include Machakos Senator Johnstone Muthama and ODM Nairobi chairman George Aladwa.

A Nairobi court had previously dismissed an application by Kuria seeking to compel Mobile Services Provider Safaricom to release to him phone records of the Law Society of Kenya CEO Apollo Mboya, who he accuses of forwarding his name to the National Cohesion and Integration Commission (NCIC).

Kuria had told the court that he intended to use the phone records in his defence accusing Mboya of maliciously forwarding his name to NCIC over allegations of hate speech.

Mboya had testified that he had received calls from people complaining of Kuria’s tweets, something Kuria says is not true and the more reason Safaricom should be compelled to release the phone records.
