Most wanted gang in court to block arrest over attack on businessman

Five men accused of assaulting and robbing a Nairobi businessman Timothy Muriuki have moved to court seeking anticipatory bail.

The five; Dishon Mulinge, Ronald Otieno, Michael Mbanya Wathigo, Hussein Suleiman and Brayan Shem Owino claim that their personal security is at risk adding that they stand the risk that they may be clandestinely and extra judicially eliminated.

They also say that if required for questioning or investigations by the police, they should be questioned at CID headquarters or Mazingira house in the presence of their advocates.

“The applicants are ready and willing to submit themselves to a just and fair legal system in which their fundamental rights and freedoms are respected and protected ,”they say

They have named DPP, IG and DCI as respondents in the case.

Further, they want the court to summon the DCI and IG to personally appear in court to show cause in the event that the order is disobeyed.

Through their lawyer Michael Osundwa Sakwa, they claim that the police have already branded them as goons, attackers, rapists, thieves and wanted criminals for robbery with violence and attached their photos in notices.

The five were captured on camera manhandling the former Nairobi Central Business District Association (NCBDA) chairman at Hotel Boulevard 10 days ago.
