Mother sues Sunshine Secondary School teachers for causing physical pain to her child

A mother has sued the Board of Management of Sunshine Secondary School and three teachers seeking general damages for physical pain and psychological anguish allegedly caused to her child by the teachers.

Yolande Opiyo in her petition argued that in 2015 when her son went home for the holidays, she realized that he had several marks and swellings on one of his legs and could not sit well.

According to Yolande’s son, the marks and swellings were as a result of beatings he had received from some teachers for allegedly failing to meet the targets set in some exams.

She further argues that the situation persisted despite her meeting with the school administration over the matter.

She now wants the court to direct Teachers Service Commission to immediately suspend the teaching licenses for the three teachers and take disciplinary action against the respondents.

The parent to the form two student claims that failure by the respondents to issue a remedy to the situation violated the minor’s fundamental rights to be protected from abuse.
