MP to petition UN, ASP to reverse Rule 68 of the ICC

South Pokot Member of Parliament David Pkosing has commenced the process of petitioning the Assembly of State Parties (ASP) and the United Nations (UN) to advice the International Criminal Court (ICC) on the application of Rule 68 in the case of Deputy President William Ruto and journalist Joshua Arap Sang.

In a press conference in Kapenguria, Pkosing said the petition will be signed by Members of Parliament on behalf of the people of Kenya and it will take 14 days to have it ready.

The petition process comes less than two weeks since Gatundu South Member of Parliament Moses Kuria revealed in public that together with NARC Kenya leader Martha Karua, they procured witnesses to testify against Ruto and Sang.

Kuria also alleged that former Prime Minister Raila Odinga and Kisumu Senator Anyang Ny’ong’o also implicated Ruto in the ICC case.

“It is now common knowledge and in public domain that ICC witnesses were procured and coached to implicate the Deputy President and Joshua Sang,” said Pkosing.

Pkosing says he is petitioning ASP in accordance with Rule 83 and 84 of Rules and Procedures concerning oversight of the ICC. He further says he will petition the UN in accordance to Rule 35 and 36 giving UN participatory role in ASP.

The petition, according to him, demands that ASP and UN order for a total review of ICC witness identification process in the Ruto, Sang case with a view of establishing the facts of the procurement and coaching of witnesses.

“All these revelations have clearly demonstrated the innocence of the two,” he said.

He also demands that UN and ASP, in the process of auditing the whole witness saga, adjourn the proceedings and hearing of this case until the controversies surrounding witnesses are cleared.

“The continuation of the ICC case will only be mockery to justice and international law.”

The legislator further stated that if ASP and UN do not listen to the prayers, then it will be clear to the world that ICC is not about justice, peace and well being of the world as espoused by the preamble of the Rome Statute but a fixer itself and that it should be disbanded.
