Muite wants court to dismiss DPPs bid to bar him from fertilizer case

Senior Counsel Paul Muite on Monday asked the court to dismiss an application by the Director of Public Prosecutions (DPP) seeking to bar him from representing a businessman accused of importing fertilizer alleged to contain mercury.

This comes after the DPP, through State Prosecutor Victor Owiti, last month said Muite had represented the Kenya Bureau of Standards (KEBS) in other disputes and was therefore privy to confidential information and witness statement.

According to Mr. Owiti, this was likely to interfere with the criminal case, thus the need for the lawyer to be recused from the matter.

Muite, however, vehemently denied these allegations saying he has never been on the KEBS retainer.

“I am not and have never been on KEBS list of long or short term retained counsels. No annexures have been placed in court to show the alleged retainer agreement between KEBS and me,” argued Muite.

The matter will be heard on Monday next week.
