Court allows man accused of stealing Ksh.20M to go on holiday in South Africa

A Nairobi court on Tuesday dismissed three applications by a businessman accused of stealing Ksh.20.6 million from a South Africa-based company.

Appearing before Makadara Court Principal Magistrate Meresia Opondo, Wycliffe Simiyu applied to have the court compel the complainant to issue him with certified copies of his passport.

The court, while denying him unlimited access to his passport, however considered an existing order which grants him limited access whenever he needs to travel.

He was thereby issued with his passport to travel to be with his family in South Africa for holidays but ordered to redeposit it back in court on May 9, 2019 when the matter will be heard further.

Magistrate Opondo also declined an application to have the complainant be recalled to testify in the matter saying the case has been in court for long.

The magistrate further added that the accused is not genuine to purport to recall a witness who testified long ago and both parties indicated satisfaction.

Mr. Koyabe, in the case, is facing a charge of stealing by agent contrary to Section 268 as read with Section 283 of the Penal Code.

He was charged that, on June 12, 2014, at Cooperative Bank — Stima Plaza branch – and being an agent to KOMATSU in South Africa, he stole cash Ksh.20,655,000 which he was supposed to remit to the said company for the purpose of purchase and delivery of a bulldozer.
