The Magistrate further noted that issues raised can be dealt during the main hearing of the case.

“On the issue on charging the station that aired the content and those involved should have been charged court rules that the ODPP is independent and can’t be directed in who to be charged and not to be charged,” the Magistrate said.

Ledama was charged with one count f ethnic contempt and pleaded not guilty.

Prosecution then asked the court to bar the Senator from commenting on the case adding that they were not opposed to his release on bail.

The court then ordered his release on a cash bail of Ksh. 100,000 and ordered him not to comment on the case until the matter is heard and determined.
