NASA petition inadequate; numbers say it all Uhuru
President Uhuru Kenyatta, who is the 3rd respondent in a petition lodged by the National Super Alliance (NASA) at the Supreme Court challenging the credibility of the August 8 General Elections, says the complaints raised by NASA in the petition are inadequate to invalidate the presidential election outcomes.
In his response to Supreme Court, President Kenyatta has denied all accusations adjured by NASA leader, Raila Odinga and his running mate, Kalonzo Musyoka, who are the 1st and 2nd petitioners respectively, absolving himself of violation of the principles of a free and fair election and electoral process, the voting, counting and tabulation of results, substantive non-compliance, irregularities and improprieties and rejected votes.
In his affidavit, the Head of State denied that him, together with the Deputy President, William Ruto, are not ‘computer generated’ leaders as coined by opposition leader in his statement, adding that the 1st petitioner, Raila Odinga, has a habit of disparaging election results.
Further, he has refuted that he violated the Rule of Law and the Principles of the Conduct of a free and fair election by intimidating and coercing Public Officers, repudiating the allegations of improper influence of voters as pleaded in the petition, saying the allegations are devoid of sufficient evidence.
Also, he renounced NASA’s accusations of threatening local Chiefs who were allegedly not campaigning for his re-election while addressing campaign rallies in Makueni, absolving his remarks as an out of context report and that he was only cautioning chiefs not to depart from their obligation to maintain political neutrality.
President Uhuru equally responded to Dr. Nyangasi Oduwo’s affidavit in which he terms her allegations ‘generalised’, noting that he did not corruptly influence voters and was not aware of Cabinet Secretaries who openly abused their offices and state resources to advance his political interests.
He, however, argued that the Deputy President’s right to natural justice is being violated on the grounds that, Mr Ruto is charged with offenses and has been exempted from the Petition and consequently, cannot respond to the accusations.
President Kenyatta further showed that his party, Jubilee Party, secured majority of the seats across all the elective posts in the just concluded polls.
With a total of 214 elected representatives, Jubilee topped with 25 Governors, followed by Orange Democratic Party with 13 Governors and Wiper Democratic Movement of Kenya (WDMK), FORD Kenya and Independents grasping two seats.
As for KANU, MCCP and NARC, they clutched one Gubernatorial seat each.
As for the Senatorial seats, Jubilee Party takes the lead with 25 Senators followed by ODM with 13 Senators, ANC, KANU and WDMK with 2 seats each, CCU, PDR and FORD-KENYA take a seat each.
Out of the 289 elected Members of Parliament, Jubilee Party bagged 139 seats followed by ODM with 62 seats, Wiper 19, Independent candidates taking 13, ANC 12, FORD-KENYA 10, KANU 8, EFP 4, MCCP and PDR 3, CCM, KNC, KPP and PDP 2 seats each, CCU, MUUNGANO, DP, FAP, PNU, ND and NAPK got 1 seat each.
25 Women Representatives came from Jubilee Party, ODM shadowed with 11 women reps, WDMK took 3 seats followed by KANU with 2 seats and ANC, EFP, FORD-KENYA, IND, MCCP AND PDR securing 1 seat each.
Jubilee party will maintain the post of Majority Leader in the 12th Parliament.
The date of the pre-trial conference has been scheduled for Saturday, August 26 at 7:00 pm at the Supreme Court of Kenya.
