NASAs list of EALA nominees challenged in court

A FORD-Kenya Party official on Wednesday moved to court to challenge the list of nominees to the East African Legislative Assembly (EALA) submitted by the National Super Alliance (NASA).

The Ford-K party Assistant Secretary General, Yasser Ali Sheikh, argues that the list bears no nominee from Ford-K and that his name was excluded from the list tendered to the National Assembly clerk Micheal Sialai.

“Ford-K was not consulted nor provided with an opportunity to lobby for its preferred candidate,” claimed Yasser.

The Ford-K party Assistant Secretary General said that there was no legal obligation on the part of the respondents and the clerks of parliament to publish the list of the nominated candidates provided by NASA.

“In failing to take into consideration the inclusion of a member from one of its coalition partners and also a member for the Coast region a stronghold of NASA amounts to a heinous act of impunity on the part of organs of the coalition,” said Yasser.

He averred that the nomination process by NASA was flawed and in contravention of article 47 of the constitution.

He wants NASA compelled to produce the original minutes of the meetings where NASA’s affiliate parties agreed on its nominees to house leadership positions.

He also wants the court to stop the 12 nominees from canvassing, lobbying, campaigning or seeking the support of any member of parliament that will sit in the joint select committee that will vet the nominees.

Mr. Yasser asked the court to issue orders that will bar parliament from recognizing the nominees as duly elected members to the EALA if parliament approves their nomination.

Last week, NASA submitted the names of their EALA nominees to Parliament.
