Nelson Havi: IEBC must continue preparations for Nairobi by-election

Law Society of Kenya President Nelson Havi has poked holes into the vetting and approval Anne Kananu as the Nairobi governor designate.

While appearing for an interview with Citizen TV’s Waihiga Mwaura on Tuesday night, Havi said the IEBC must continue preparing for the March by-election.

He argued that the fact that there was no deputy governor in office when Sonko was impeached meant that the only option was to hold a by-election.

“IEBC must continue the preparations towards a by-election and the people of Kenya must assert their authority,” Havi said

“The process of appointment of a deputy governor starts and stops with the governor, a governor in an acting capacity cannot purport to appoint a deputy,”

He accused President Uhuru and Raila of angling to second someone to deputise Ms Kananu when she was illegally installed.

“The people of Nairobi must realise the danger that we are likely to fall into… The President and the former PM are angling to second somebody to deputise Anne Kananu as and when she is unlawfully installed as governor,” he claimed.

Havi also claimed the former Governor Mike Sonko was targeted with dubious accusations so that he would step aside and allow for transfer of money from the county to NMS.

He claimed that the NMS exists as an entity whose legal credibility cannot be found.

“NMS (Nairobi Metropolitan Services) is an entity whose legal credibility cannot be found, why is it being given monies that are intended to be utilized by officials of the county government?” He posed.

ODM secretary general Edwin Sifuna who was also at the same panel argued that the appointment of Ms Kananu was done in accordance with the law as she was appointed by a sitting Governor.

“Sonko never took his job seriously, all the time he sent out these names to the assembly he was doing it as a joke, you remember he even proposed Miguna Miguna and even did a Facebook poll asking Kenyans to nominate a person,” Sifuna said.

He argued that Sonko could not have purported to withdraw the nomination since the name had been cleared by the IEBC’s returning officers.

“Once a candidate has been cleared by the IEBC you cannot then wake up and say you are withdrawing the nominee, the only thing that stopped the vetting of Ms Kananu was an existing order,” he added
