New twist as Sarah Wairimu refuses to attend reading of Tob Cohens will

Sarah Wairimu, the wife of murdered Dutch tycoon Tob Cohen, now says she will not attend the planned opening of her late husband’s will scheduled for Friday, September 20.

Through her lawyer Philip Murgor, Sarah claims that contents of Tob Cohen’s will have been “severely compromised.”

She alleges that a recent newspaper article that claimed Tob Cohen left to his sister a Ksh.400 million villa in Nairobi casts doubt on the legitimacy of the will.

“It is evident that the confidential nature of the will you claim to possess or any others for that matter has been severely compromised, to the extent that our client has instructed us to inform you that she does not wish to participate in any related process,” says Sarah, in a letter dated September 19, 2019, written by her lawyer.

Sarah maintains that any will set to be executed on behalf of her late husband must be proved through an appropriate application to the High Court.

“Our client is well aware, that any purported wills must be proved through an appropriate application to the High Court for probate to determine their validity. In the circumstances, we have been instructed not to attend the proposed opening of the will,” the letter further reads.

The letter is addressed to Kirundi & Company Advocates, which is said to be in possession of Tob Cohen’s will, and also copied to the late tycoon’s brother Bernard Cohen, sister Gabriel van Straten and lawyer Danstan Omari.

Kirundi & Company Advocates had invited Sarah Wairimu and her lawyer as well as Gabrielle Cohen, the sister of the late businessman represented by Cliff Ombetta to a will opening session at their offices at 11:30 am to read its contents.

Earlier on, Sarah, through her lawyer, had written to Chiromo mortuary insisting that she should be the one to pick her late husband’s body and not his sister Gabriel, who had also demanded she be given the body as soon as the post-mortem is conducted.

The two parties have since agreed of the funeral modalities. The burial ceremony will be private and for family members only with Sarah and Gabrielle participating as widow and sister respectively.

Wairimu is currently remanded at the Lang’ata Women’s Prison as police complete investigations into her alleged involvement in the murder of her husband.

The late Tob Cohen is set to be laid to rest on Monday at a Jewish cemetery in Nairobi.

On Thursday, lawyers said the Monday funeral that is scheduled for 2pm can only proceed subject to obtaining a court order.

The lawyers have urged the Director of Public Prosecutions (DPP), Directorate of Criminal Investigations (DCI) and prison authorities to facilitate the arrangement.
