Nixon Korir validly elected as Langata MP, court rules

The Court of Appeal has upheld the election of Langata Member of Parliament Nixon Korir.

The court ruled that there was no basis to warrant a nullification of the election of Nixon Korir.

“The appeal has no merit and is hereby dismissed,” the judge ruled on Friday.

Speaking to journalists after the ruling, Nixon Korir said he is willing to work with his rivals irrespective of their differing political ideologies.

“I want to tell my competitors that I wish to work with them to deliver what we promised to the people of Langata. I welcome my opponents to work together with me,” he said outside the courtroom.

The petitioner Oscar Omoke had moved to court in 2017 to challenge the election of Nixon Korir and claimed massive irregularities.

However, the High Court upheld the MP’s win in a ruling delivered in February this year, with the judge citing insufficient evidence as the reason for failing to invalidate the election.

“The petitioner failed to prove his allegations of election irregularities ranging from intimidation of his agents, misuse of public resources and alterations in forms 35A,” the judge ruled.

It was after this ruling that Omoke then sought the intervention of the Appellate Court.
