Nominated MP Godfrey Osotsi wants ANC decision to expel him quashed

Embattled Nominated Member of Parliament Godfrey Osotsi on Tuesday filed a case before the constitutional division court challenging his expulsion from the Amani National Congress (ANC) party.

Osotsi, who is seeking court protection, now wants the decision of the party’s disciplinary committee and the National Executive Committee (NEC) quashed.

The legislator accused the Musalia Mudavadi-led party of “consistently, deliberately and malicious” withholding essential information that would enable him to respond to the charges leveled against him and facilitate his application for an appeal or review.

“From the evidence herein, it is evident that the impugned decision is the continuation of an unlawful campaign against Osotsi to suppress his democratic right to dissent and is otherwise totally unfounded and malicious,” the court heard.

In a letter dated January 10, 2019, the party disciplinary committee secretary Dan Ameyo wrote to Osotsi notifying him of complaints of financial improprieties allegedly flagged by the Auditor General, further informing him of commencement of disciplinary proceedings.

The allegations against the former ANC Secretary General were that he failed to prepare a budget or financial statement and failed to honour party invitations to explain various queries.

He was also accused of failure to account for Ksh.50 Million as well as suspicions of failing to remit all revenue received by the party.

According to his lawyer, the MP — since October 2017 — has had no access or control of the party records having been “illegally” ousted from office.

In his defense, Osotsi said that, according to the party constitution, the treasurer of the party is in charge of the party finances and budgets at all party levels.

“In light of the foregoing, the invitation to the MP to explain the queries relating to the constitution mandate of the party treasure and whose records were in the exclusive control of the party was mischievous, unreasonable and merely for procedural expediency,” added the lawyer.

Osotsi further argued that there is  a frantic pre-occupation with ensuring that he  is struck of the register of members of the party and to commence removal proceedings against him as MP.
