Activist Okiya Omtatah has filed an application at the High Court seeking to have the National Transport and Safety Authority (NTSA) Director General Francis Meja held in contempt of court over the suspended curriculum for training and testing of drivers.

Omtatah wants the court to jail the NTSA boss for a period of six months or fine him Ksh.200,000, an amount the activist says should be directly deducted from Meja’s salary.

The activist claims that he served the respondents with the court orders suspending the curriculum on March 29, 2018, but the transport authority has deliberately and contemptuously failed and refused to comply with the said orders.

“The blatant refusal by NTSA to obey a valid court order is a contempt act and that the actions by the agency are offences against the administration of justice,” says Omtatah.

He argues that in imposing the directives and curricular which were suspended after an interparty hearing, the rule of law in Kenya stands to suffer irreparable harm and damage.

In March, the court suspended a public notice issued by NTSA requiring all driving schools and public service vehicle operators to be vetted.

Justice George Odunga also stopped the agency and the Ministry of Transport from disabling the e-citizen password of driving schools that would not comply with the new regulations.
