NTSA official linked to Riverside attack pleads for release

One of the National Transport and Safety Authority officials detained for 30 days in relation to the 14 Riverside Drive attack now wants the court to revise its orders.

Jacqueline Githinji argues that she has been unconstitutionally detained pending completion of the investigations.

She further says she is ready to take leave from her work station and assist investigators in unravelling the truth behind the mystery of identical number plates of the vehicle used by the terrorists.

“The applicant continues to be detained at Muthaiga Police cells without being formally charged or a holding charged being preferred against them,” reads the application.

She now wants the court to revise the period of detention or order her release on term adding that she is willing to comply and abide by any terms that the court will set.

Though her lawyer, Githinji notes that on January 30,2019, she was arrested while on duty at the main offices of the NTSA.

According to her, 30 days detention is excessive and unreasonable since the investigators have confiscated her mobile phone and electronic equipment including computers.

“I have a fixed abode and being a mother of three absconding or failing to comply with the bond terms is impracticable,” said Githinji.

She accused NTSA officers of indiscriminate arrest, an act that she says is leading to continuous violation of her rights and fundamental freedom.

The Anti-Terrorism Police Unit (ATPU) however maintained that they need the 30 days to complete investigations.

ATPU cited the two vehicles bearing the same registration number plate KCN 304E with one having been used in the commission of the terror attack and the other one having been found elsewhere in Kitengelea.

The investigations seek to establish who issued the fake number plates to the terrorists.

The matter will be heard on Thursday, February 7, 2019.
