NYS boss Richard Ndubai will intimidate witnesses if freed: DPP

The Director of Public Prosecutions has asked the High Court to dismiss an application for bail review filed by embattled National Youth Service (NYS) Director General Richard Ndubai.

According to the DPP, a majority of witnesses lined up to testify in the cases against Mr. Ndubai were officers working under him is juniors, hence, he could intimidate them if freed on bail.

“The majority of the witnesses set to testify in the cases that the Applicant (Richard Ndubai) faces are junior officers who were under him hence a very high likelihood of interference and intimidation of witnesses,” says the DPP.

In an affidavit filed by Inspector of Police Paul Waweru, the DPP says it will be just and fair if the court dismisses the applications and orders sought.

Waweru further says that evidence gathered by the investigating team shows that Ndubai was part and parcel of the entire fraud case pending before the court.

“The matters raised by the applicants in their affidavit for refusal of bail are matters of judicial discretion where the law is very well settled that Courts exercise its discretion in a judicious manner and that applicants right to bail under article 49 (1 )(h)is not absolute,”says Waweru.

The DPP says he is committed to expeditious hearing and disposal of the case even if it means for long hours.

Anti-Corruption court Magistrate Douglas Ogoti declined to release the NYS scandal suspects on bail noting that the accused persons are charged with Economic Crimes which are serious offences.
