NYS cash theft suspect Josephine Kabura to be arrested

The Court has issued a warrant of arrest against National Youth Service (NYS) cash theft suspect businesswoman Josephine Kabura after she failed to appear before it to answer to money laundering charges.

The warrant was issued by Nairobi Chief Magistrate Daniel Ogembo after Kabura failed to appear in court for the mention of the case where she is accused of money laundering.

Ogembo also directed a comprehensive medical report on Charity Ngethi be produced in court and directed all the accused persons in the matter appear in court next week Tuesday for the hearing of the application in which they are challenging the jurisdiction of the Magistrate Court to prosecute them.

In the matter, the prosecution has opposed the application by the 11 accused persons arguing that they should take plea.

“The accused must have their day in court, they are taking us round and round with similar applications. They must answer to the charges,” the prosecution submitted.

On June 29th, 2016, High Court Judge George Onguto declined to stop their prosecution and directed that they argue their matter in the trail court.

Onguto also ruled that the Director of Public Prosecutions (DPP) did not violate the Constitution in preferring the money laundering charges.

“I do not hold the view that the DPP can be faulted. I am not convinced that the charge as drafted is a revelation of a DPP who did not appreciate the offence. Quite the contrary he did,” Justice Onguto ruled.

The 11 among them businesspersons Ben Gethi, his mother Charity Wangui Gethi, lawyer Patrick Ogolla and Josephine Kabura and others are required to answer to money laundering charged over the 791 million shillings National Youth Service (NYS).

The suspects have been challenging the charges against them and have never taken a plea at the Magistrate Court.

The DPP preferred the charges against the 11 suspects February this year.
