NYS suspects appeal bail denial, claim they are sick

Two suspects charged over the multi-billion National Youth Service (NYS) scandal have moved to court to challenge the decision to deny them bail.

The two, James Thuita and Yvonne Wanjiku Ngugi, claim they are sickly and in need of specialised treatment.

The suspects further claim that Magistrate Douglas Ogoti failed to uphold the presumption of innocence until proven guilty.

“That the most paramount consideration in granting bail is in the assurance to the court that the accused persons will attend court. The prosecution did not present any evidence at all to show that the applicants were likely to abscond court in the event they were granted bail,” reads the appeal.

The appeal by the two suspects comes a day after the Anti-Corruption court denied all NYS suspects bail saying they are charged with Economic Crimes which are serious offences.

“It is the opinion of the court that it can lead to anarchy, threat to peace and national security.This in itself is a compelling reason why bail should and is hereby denied,” ruled Ogoti.
